Map of Anti Gender-Affirming Care Bills & Bans [Updated 01.18.23]

There are currently at least 57 bills attempting to limit or ban gender-affirming care across 21 states. Three states have already enacted GAC bans.

In total count, there are at least 57 known anti-trans bills which specifically seek to limit or ban gender-affirming care (GAC) across 21 states. Three states have enacted GAC bans. And there has been a national anti-GAC bill introduced into the U.S. House of Representatives.

US NATIONAL ANTI-GAC BILL

1. HB9507 - To amend the Child Abuse Prevention and Treatment Act. Prevents State child protective services systems from removing a child from the custody of the child’s parent or legal guardian due to the parent’s or legal guardian’s reluctance or refusal to consent to the child receiving a gender-transition intervention, and for other purposes.

STATES WITH 10 ANTI-GAC BILLS

Indiana

1. HB1118 - Prohibited services relating to care of minors. Prohibits specified health care professionals from: (1) performing, or causing to be performed, certain medical procedures on a minor; or (2) subjecting a minor to certain activities that purposely attempt to change, reinforce, or affirm a minor's perception of the minor's own sexual attraction or sexual behavior, or attempt to change, reinforce, or affirm a minor's gender identity when the identity is inconsistent with the minor's biological sex.

2. HB1220 - Gender transition procedures for minors. Prohibits a physician or other practitioner from knowingly providing gender transition procedures to an individual who is less than 18 years of age (minor) that are intended to alter the gender of the minor.

3. HB1231 - Gender transition procedures for minors. Prohibits specified health care professionals from providing gender transition procedures to a minor that are intended to alter the gender of the minor or delay puberty.

4. HB1232 - Child removal and gender identity. Prohibits lack of GAC from being considered child abuse or neglect.

5. HB1407 - Parental rights. Explicitly makes not providing GAC legal and NOT child abuse.

Kansas

1. SB12 - Kansas Child Mutilation Prevention Act. Would criminalize performing gender reassignment surgery or prescription of hormone replacement therapy on certain persons and providing grounds for unprofessional conduct for healing arts licensees.

Kentucky

1. HB120 - Create new sections of KRS Chapter 311. To prohibit the provision of or referral for gender transition procedures to any child under the age of 18 years; define a violation as unprofessional conduct and acting recklessly for purposes of tort claims.

Mississippi

1. HB456 - An Act To Amend Section 43-21-105, Mississippi Code Of 1972, To Revise The Definition Of Child Abuse To Include Gender Reassignment; And For Related Purposes. Would amend the definition of abused child to include: "a child whose parent has administered, supplied or consented to or assisted in the administration or supply of, a puberty suppression prescription drug or cross-sex hormone to a child, other than an intersex child, for the purpose of gender transitioning or gender reassignment; or performed or consented to the performance of surgery or another medical procedure on a child, other than an intersex child, for the purpose of gender reassignment."

Missouri

1. HB419 - Creates provisions relating to gender transition procedures.

2. HB463 - Creates provisions relating to gender transition procedures.

3. HB540 - Creates provisions relating to gender transition procedures.

4. SB164 - Establishes the "Missouri Save Adolescents from Experimentation (SAFE) Act".

5. SB236 - Modifies provisions relating to gender reassignment treatment for children.

6. SB281 - Prohibits hormonal or surgical gender reassignment for a child under eighteen years of age.

7. SB377 - Creates new provisions relating to public contracts. To amend chapter 34, RSMo, by adding thereto one new section relating to prohibiting public entities from entering into contracts with companies engaged in economic boycotts a business that does not facilitate, is not expected to facilitate, or does not commit to facilitate access to abortion, sex or gender change, or transgender surgery or medical treatments.

Nebraska

1. LB574 - Adopt the Let Them Grow Act. Minor gender-affirming care ban.

New Hampshire

1. HB417 - Relative to the definition of child abuse. Definition of Abused Child; Sexual Reassignment Added; Subjected to drug treatments or surgery in an attempt to alter the sex of the child assigned at birth, except in rare cases of ambiguous genitalia.

2. HB619 - Prohibiting gender transition procedures for minors, relative to sex and gender in public schools, and relative to the definition of conversion therapy.

New Jersey

1. S3076 - Establishes "Child Protection and Anti-Mutilation Act."

North Dakota

1. HB1254 - Relating to the prohibition of certain practices against a minor; to provide a penalty; and to declare an emergency.

Oklahoma

1. HB1011 - Public health and safety; defining terms; health care professionals; gender transition procedures; referrals; exceptions; public funds; Medicaid program reimbursements; felony penalties; statute of limitations; unprofessional conduct; license revocation

2. HB1337 - Oklahoma Save Adolescents from experimentation (SAFE) Act. Gender-affirming care ban up to age 21.

3. SB129 - Health care; creating the Millstone Act of 2023. Prohibiting provision of or referral for gender transition procedures; providing for criminal, administrative, and civil enforcement.

4. SB250 - Public programs; prohibiting public funding for provider of gender transition procedures; allowing reapplication under certain conditions.

5. SB252 - Health care; prohibiting certain medical treatment for minors; providing administrative penalty.

Oregon

1. SB129 - Prohibits physicians from performing irreversible gender reassignment surgery on minor. Prohibits physicians from performing “irreversible gender reassignment surgery” on minors. Creates exceptions for intersex children.

South Carolina

1. H3197 - Parental Bill of Rights.

2. H3551 - South Carolina Vulnerable Child Compassion and Protection Act.

3. S0234 - Parents Bill of Rights.

4. S0243 - Gender reassignment. To amend the South Carolina Code of Laws by adding Section 40-47-205, Relating to general provisions concerning physicians, so as to prohibit physicians from performing gender reassignment surgery on minors, and to prohibit physicians from prescribing or administering certain substances for the purpose of attempting to alter the appearance of or affirm the minor’s perception of his gender if that appearance of perception is inconsistent with the minor’s biological sex.

6. S0276 - Biological Sex Constitutional Amendment. Would define the biological indication of male or female in the context of reproductive potential or capacity, such as sex chromosomes, naturally occurring sex hormones, gonads, and non-ambiguous internal and external genitalia present at birth, without regard to an individual's psychological, chosen, or subjective experience of gender shall constitute a person's gender for the purposes of this constitution and the laws of this State.

Tennessee

1. HB0001 - AN ACT to amend Tennessee Code Annotated, Title 28; Title 29; Title 33; Title 34; Title 36; Title 37; Title 39; Title 40; Title 49; Title 56; Title 63; Title 68 and Title 71, relative to medical care of the young. As introduced, prohibits a healthcare provider from performing or offering to perform on a minor, or administer or offer to administer to a minor, a medical procedure if the performance or administration of the procedure is for the purpose of enabling a minor to identify with, or live as, a purported identity inconsistent with the minor's sex or treating purported discomfort or distress from a discordance between the minor's sex and asserted identity.

Makes it unlawful for an individual to engage in the following practices upon a minor, or cause the practices to be performed, to facilitate the minor's desire to present or appear in a manner that is inconsistent with the minor's sex designated at birth.

Texas

1. HB41 - Relating to professional liability insurance coverage for and prohibitions on the provision to certain children of procedures and treatments for gender transitioning, gender reassignment, or gender dysphoria.

2. HB42 - Relating to the definition of child abuse.

3. HB122 - Relating to professional liability insurance coverage for and prohibitions on providing to certain children procedures and treatments for gender transitioning, gender reassignment, or gender dysphoria; creating a criminal offense.

4. HB436 - Relating to the definition of child abuse and the prosecution of the criminal offense of abandoning or endangering a child. Administering or supplying, or consenting to or assisting in the administration or supply of, a puberty suppression prescription drug or cross-sex hormone to a child, other than an intersex child, for the purpose of gender transitioning or gender reassignment; or performing or consenting to the performance of surgery or another medical procedure on a child, other than an intersex child, for the purpose of gender transitioning or gender reassignment.

5. HB672 - Relating to the definition of child abuse and the prosecution of the criminal offense of abandoning or endangering a child. Administering or supplying, or consenting to or assisting in the administration or supply of, a puberty suppression prescription drug or cross-sex hormone to a child, other than an intersex child, for the purpose of gender transitioning or gender reassignment; or performing or consenting to the performance of surgery or another medical procedure on a child, other than an intersex child, for the purpose of gender transitioning or gender reassignment.

1. HB0132 - Prohibiting Sex Transitioning Procedures on Minors.

1. SB791 - Establishment of the Save Adolescents from Experimentation (SAFE) Act. Defines health benefit plans and prohibits gender transition procedures

2. SB960 - Youth Health Protection Act. Establishes civil penalties and makes it unlawful for any individual to provide gender transition procedures

3. SB1203 - Children Deserve Help Not Harm Act. Defines health benefit plans; coverage for gender transition.

Washington

1. HB1214 - Enacting the protecting children's bodies act. A health care provider may not provide gender transition procedures to any individual who is under 18 years of age.

West Virginia

1. HB2007 - Prohibiting certain medical practices.

Wyoming

1. SF0111 - Child abuse--change of sex. Would make it a 10 year felony for providing gender-affirming care.
